Legal Requirements


The Control of Asbestos Regulations changed significantly in 2006 and placed the onus on ‘Duty Holders’ e.g. owners, Directors, site managers etc., to proactively locate asbestos containing materials(ACMs) on their premises and assess and monitor their condition. These Regulations bring together the three previous sets of Regulations covering the prohibition of asbestos, the control of asbestos at work and asbestos licensing. The regulations were again updated in 2012 and included the recommendation to have the condition of known ACMs inspected at least annually by a professionally qualified individual.

Regulation 4 of the Asbestos Regulations cover the ‘duty to manage’ asbestos in non-domestic premises by defined The Duty Holder. Landlords also have a Duty of Care to ensure that asbestos is managed in their properties, especially in communal areas.
